    Divorce and Real Estate

    We can’t fix the divorce.

    We can, however, help with real estate issues surrounding divorce.

    First, before you do anything, say anything, promise anything take a step back and consider your options. Most of the time, the emotions run high, and it’s easy to make a decision you’ll later regret.

    As an example, in Missouri, be wary of purchasing a new home before the divorce is settled. That new home (if purchased while you are still married) becomes community property – and now becomes an asset in the divorce.

    Also – signing off your rights to a property does not automatically disolve you from the responsibility of making sure the mortgage gets paid.  If your name is on the mortgage, you could still be legally responsible for payment. And if your ex doesn’t make the payments they promise they are going to make – your credit could be affected!

    We work together with your attorney to determine the best course of action regarding your home.  If sale before the divorce is final, we work as as the voice of reason between you and your spouse.
